Seller Agreement

1. Introduction
This Seller Agreement ("Agreement") is entered into between you ("Seller") and TotalTCG Ltd, operating the TotalTCG platform at https://www.totaltcg.com ("Platform"). This Agreement governs your use of the Platform as a seller of trading cards and related products.
By registering as a seller, creating a listing, or otherwise offering items for sale on the Platform, you acknowledge that you have read, understood, and agree to be bound by this Agreement. This Agreement supplements our Terms of Service, which continue to apply to your use of the Platform. In the event of a conflict between this Agreement and the Terms of Service, this Agreement shall prevail in relation to selling activities.
2. Eligibility
To sell on the Platform, you must meet all of the following requirements:
- You must be at least 18 years of age
- You must have a valid payment method and bank account capable of receiving payouts via Stripe
- You must be a resident of the United Kingdom or another country supported by our payment processor
- You must provide accurate and complete identity information, including your legal name and address
- You must comply with all applicable local, national, and international laws and regulations relating to the sale of goods
- You must not have been previously suspended or permanently banned from selling on the Platform
3. Listing Requirements
When listing items for sale on the Platform, you must adhere to the following standards:
3.1 Descriptions & Photographs
- Provide accurate and complete descriptions of each item, including card name, set, rarity, and any notable defects
- Include clear, well-lit photographs that accurately represent the item's condition
- Only list authentic, genuine items — counterfeit or replica items are strictly prohibited
- You must only list items that you legally own and have the right to sell
3.2 Condition Grading
All cards must be graded using the Platform's standard condition scale. You must select the condition that most accurately reflects the item's state:
- NM (Near Mint): Card is in excellent condition with minimal to no visible wear
- LP (Lightly Played): Minor edge wear, light scratching, or slight whitening
- MP (Moderately Played): Noticeable wear including creasing, moderate whitening, or surface scratches
- HP (Heavily Played): Significant wear, heavy creasing, major whitening, or other substantial damage
- DMG (Damaged): Severe damage including tears, water damage, bends, or writing on the card
3.3 Pricing & Availability
- All prices must be listed in GBP (British Pounds Sterling)
- Prices must be fair and not designed to manipulate the Platform's pricing data
- You must promptly update or remove listings if an item becomes unavailable
- You may not list the same item on multiple platforms simultaneously unless you can guarantee fulfilment on all of them
4. Fees & Payment
4.1 Platform Commission
The Platform charges a commission of [X]% on each completed sale. This commission is automatically deducted from the sale proceeds before payout. The commission covers Platform maintenance, buyer protection, and payment processing infrastructure.
4.2 Payment Processing
- Payments are processed via Stripe; Stripe's processing fees are passed through to the Seller
- You must maintain a valid Stripe account in good standing to receive payouts
- You are responsible for any taxes applicable to your sales
4.3 Payout Schedule
- Funds from completed sales are held in escrow until the buyer protection period has expired
- Payouts are processed to your nominated bank account on the schedule specified in your seller dashboard
- The Platform reserves the right to withhold payouts if a dispute, investigation, or chargeback is pending
4.4 Fee Changes
The Platform reserves the right to modify its fee structure. You will be given at least 30 days' written notice before any fee changes take effect. Continued use of the Platform after the effective date of a fee change constitutes acceptance of the new fees.
5. Shipping Obligations
- You must dispatch sold items within your stated handling time, and no later than 3 business days after the order is confirmed
- You must provide a valid tracking number for every shipment and update the order status on the Platform promptly
- Items must be packaged appropriately to prevent damage during transit — at minimum, individual cards must be placed in a penny sleeve inside a toploader
- You must provide accurate weight and dimensions for shipping cost calculations
- Risk of loss or damage remains with you until the item is confirmed as delivered to the buyer
- You are responsible for any customs declarations, duties, or additional charges for international shipments
6. Buyer Protection & Returns
6.1 Cooling-Off Period
Under the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, buyers have a 14-day cooling-off period starting from the day after they receive their item. During this period, the buyer may cancel the purchase for any reason and you must accept the return.
6.2 Returns & Refunds
- You must accept returns where the buyer exercises their statutory cancellation right
- Refunds must be processed within 14 days of receiving the returned item
- For items that are faulty, not as described, or significantly different from the listing, you must accept the return at your own cost
- Buyers have a 30-day right to reject faulty goods under the Consumer Rights Act 2015
6.3 Dispute Resolution
All disputes between buyers and sellers must first be raised through the Platform's dispute resolution system. The Platform will review the evidence provided by both parties and make a determination. Sellers agree to cooperate fully with the dispute resolution process and abide by the Platform's decision.
7. Seller Conduct
As a seller on the Platform, you agree to the following standards of conduct:
- You must not list, sell, or distribute counterfeit or replica items of any kind
- You must not engage in shill bidding or any form of price manipulation
- You must not attempt to circumvent Platform fees by directing buyers to complete transactions off-platform
- You must not solicit or facilitate off-platform transactions with users encountered through the Platform
- You must maintain professional and respectful communication with buyers at all times
- You must respond to buyer messages within 48 hours
- You must not create multiple seller accounts without prior written permission from the Platform
- You must not use the Platform to collect or harvest buyer data for purposes unrelated to completing transactions
8. Prohibited Items
The following items are strictly prohibited from being listed or sold on the Platform:
- Counterfeit, replica, or proxy trading cards
- Stolen property or items obtained through unlawful means
- Items that infringe upon any third party's intellectual property rights, including trademarks and copyrights
- Items that are illegal to sell under the laws of the United Kingdom
- Unsealed or resealed items represented as factory-sealed
- Damaged items misrepresented as Near Mint (NM) or Lightly Played (LP) condition
- Items with tampered or altered grading labels from professional grading services
The Platform reserves the right to remove any listing and take action against any seller found to be listing prohibited items, including immediate account suspension.
9. Suspension & Termination
9.1 Grounds for Suspension
The Platform may suspend your seller account, with or without prior notice, for any of the following reasons:
- Violation of this Agreement or the Terms of Service
- Suspected fraudulent activity, including listing counterfeit items
- Repeated buyer complaints or consistently low seller ratings
- Failure to fulfil orders within the required timeframe
- Unresolved disputes or excessive chargebacks
9.2 Warning System
For minor or first-time violations, the Platform operates a graduated warning system. Sellers will receive a notification detailing the violation and the corrective action required. Repeated violations or failure to address warnings may result in temporary suspension or permanent termination.
9.3 Account Termination
- The Platform may permanently terminate your seller account for serious or repeated violations
- Upon termination, all active listings will be immediately removed
- Funds may be held for up to 180 days following termination to cover potential disputes, refunds, or chargebacks
- You will receive any remaining balance after the holding period, less any amounts owed to the Platform or to buyers
9.4 Right to Appeal
If your account is suspended or terminated, you have the right to appeal the decision by contacting us at support@totaltcg.com. Appeals will be reviewed within 14 business days, and you will be notified of the outcome in writing.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Platform operates as a marketplace connecting buyers and sellers and is not a party to the transactions conducted through it
- The Platform is not responsible for the actions, conduct, or behaviour of any buyer or seller
- The Platform is not liable for any loss of profits, revenue, data, or any indirect, incidental, special, or consequential damages arising from your use of the Platform as a seller
- The Platform's total aggregate liability to you shall not exceed the total fees paid by you to the Platform in the 12 months preceding the claim
- The Platform does not guarantee the sale of any listed items or any minimum level of sales
Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Nothing in this Agreement affects your statutory rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, or any other applicable UK consumer protection legislation.
In the event that any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
