Welcome to TotalTCG. These Terms of Service ("Terms") govern your use of the TotalTCG platform located at www.totaltcg.com ("Service"), operated by TotalTCG Ltd.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the Service.

2. Service Description

TotalTCG provides:

• Card Catalog: Browse and search trading cards across supported games (currently Pokémon, One Piece)
• Collection Tracking: Manage and track your card collection
• Portfolio Analytics: View the value of your collection over time
• Marketplace: Buy and sell cards with other users
• Card Scanner: AI-powered card identification
• Price Data: Market prices aggregated from public sources

3. User Accounts

3.1 Account Creation

• You must be at least 16 years old to create an account
• You must provide accurate and complete information
• You are responsible for maintaining the security of your account
• You must notify us immediately of any unauthorized access

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited activities. You may delete your account at any time through your account settings.

4. User Conduct

You agree NOT to:

• Provide false or misleading information
• Impersonate another person or entity
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems (bots, scrapers) without permission
• Harass, abuse, or harm other users
• Post or transmit malicious code or viruses
• Violate any applicable laws or regulations

5. Marketplace Terms

5.1 Seller Responsibilities

• Accurately describe item condition and authenticity
• Ship items within the stated timeframe
• Use appropriate packaging to prevent damage
• Respond to buyer inquiries in a timely manner
• Only list items you legally own and can sell

5.2 Buyer Responsibilities

• Provide accurate shipping information
• Complete payment promptly
• Inspect items upon receipt
• Report issues within the specified timeframe

5.3 Disputes

TotalTCG is a platform connecting buyers and sellers. While we may assist in resolving disputes, we are not responsible for transactions between users. We encourage users to communicate directly to resolve issues.

5.4 Prohibited Items

• Counterfeit or replica cards
• Stolen items
• Items that infringe intellectual property rights
• Items that violate any applicable laws

6. Cancellation & Returns

Under the UK Consumer Contracts Regulations 2013, you have the right to cancel your order within a 14-day cooling-off period. This period starts from the day after you receive your item.

• To cancel, email us at support@totaltcg.com or use the cancellation form on our website
• You must return the item within 14 days of notifying us of your cancellation
• We will process your refund within 14 days of receiving the returned item
• Refunds will be issued to your original payment method
• The buyer is responsible for return shipping costs unless the item is faulty or incorrectly described
• For faulty items, you have a 30-day right to reject under the Consumer Rights Act 2015

7. Payment Terms

• Payments are processed securely via Stripe
• Accepted payment methods include credit/debit cards, Apple Pay, and Google Pay
• All prices are displayed in GBP and include applicable taxes
• Payment is taken at the time of order placement
• For marketplace transactions, funds are held in escrow until delivery is confirmed
• Platform commission and Stripe processing fees apply to sellers
• Sellers receive payment after the buyer protection period expires

8. Intellectual Property

8.1 Our Content

The TotalTCG platform, including its design, features, and original content, is owned by TotalTCG Ltd and protected by copyright and other intellectual property laws.

8.2 Your Content

You retain ownership of content you upload (such as card images). By uploading content, you grant us a non-exclusive, royalty-free license to use, display, and distribute that content as part of providing our Service.

8.3 Third-Party Content

Pokémon and related trademarks are property of Nintendo, The Pokémon Company, and associated entities. One Piece and related trademarks are property of Shueisha, Toei Animation, and Bandai Namco Entertainment TotalTCG is not affiliated with, endorsed, or sponsored by these companies. Card images and data are used for informational purposes.

9. Pricing Data

Price information displayed on TotalTCG is aggregated from publicly available sources including eBay listings. This data is provided for informational purposes only and:

• Does not constitute financial advice
• May not reflect actual current market prices
• Should not be the sole basis for buying or selling decisions
• Is updated periodically and may have delays

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• We are not responsible for transactions between users
• We are not liable for the accuracy of price data or card identification
• Our total liability shall not exceed the amount you paid us in the past 12 months

11. Indemnification

You agree to indemnify and hold harmless TotalTCG Ltd, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your marketplace transactions

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts in England and Wales.

Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.
